PRACTICE AREA

Personal injury

If you've been hurt through someone else's fault, we'll tell you honestly whether you have a claim worth making, and guide you through it if you do.

How we help

  • Car accident claims (CTP)
  • Workplace injury claims through WorkCover
  • Public liability claims, such as slips and falls
  • Claims involving unidentified or uninsured vehicles
  • Total and permanent disability claims through superannuation

How it works

  1. A free first call about what happened and how your recovery is going.
  2. We check the time limits and the evidence, and tell you plainly whether it is worth pursuing.
  3. We lodge the right notices on time and deal with the insurer for you.
  4. Most claims resolve through negotiation or at a compulsory conference, without a trial.

What it costs

For most personal injury claims we work under a conditional costs agreement. That means you don't pay our professional fees unless your claim succeeds.

Some costs may be payable whatever the outcome, such as medical reports and filing fees. If a claim goes to court and is unsuccessful, you could also be ordered to pay the other side's costs. We explain all of this in writing, with an estimate, before you sign anything.

Time limits to know

  • Car accidents: the Notice of Accident Claim must generally be given within nine months of the accident, or within one month of first consulting a lawyer, whichever is earlier.
  • Hit-and-run accidents: notice generally has to be given within three months.
  • Workplace injuries: a WorkCover application generally has to be lodged within six months, and lodging late can limit what is paid.
  • Public liability: the Notice of Claim is generally due within nine months of the injury, or one month after first instructing a lawyer, whichever is earlier.
  • Court proceedings generally have to start within three years of the injury.

General information only, not legal advice. Deadlines depend on your circumstances, so talk to us early.

Common questions

The insurer has already contacted me. Should I talk to them?

You can, but it's worth getting advice before you sign anything or give a detailed statement. What you say early can shape the whole claim.

What if the accident was partly my fault?

You may still have a claim. Compensation can be reduced to reflect your share of responsibility, but it isn't necessarily ruled out.

How long does a claim take?

Many claims take one to two years, depending on how long your injuries take to settle. We can't finalise a claim until your doctors can say what your future looks like.
